In relation to any legal action or proceedings against SMAC in a court of law regarding any matter connected or related to use or access of this website, such person accessing this website irrevocably submits to the exclusive jurisdiction of the courts of District Bangalore, Karnataka and waives any objection to such proceedings on grounds of venue or on the grounds that the proceedings have been brought in an inconvenient forum. The governing law in such legal proceedings referred to above shall be the laws of the Republic of India.

To the fullest extent permitted under applicable law, neither SMAC India nor its affiliates, including without limitation all officers, directors, employees, and agents, shall be liable to you for any damages, harm or injury whatsoever (including without limitation direct, indirect, incidental, special, consequential and punitive damages, lost profits, and damages resulting from lost data or business interruption) arising from or relating to the use of or inability to use this website and its content, whether based on warranty, contract, tort, or any other legal theory.

Payment Terms.

SMAC India (We/Us) reserve the right in Our sole discretion to change prices for Products offered for sale on the site at any time, and to correct pricing errors that may inadvertently occur. Unless otherwise agreed to by us, payment must be received by us prior to our acceptance of an order. Your order is subject to cancellation by us at our sole discretion. We are not responsible for pricing, typographical or other errors in any offer and we reserve the right to either contact you for instructions before shipping or cancel any orders arising from such errors.

Shipping; Taxes; Title; Risk of Loss.

You must notify Us within 1 days of the date of your purchase or acknowledgement if you believe any part of your purchase is missing, wrong or damaged. Shipping and delivery dates are estimates only.

Order Cancellations/Modifications.

Once an order has been placed, there is a very short time frame in which we can cancel, so we cannot guarantee that we will be able to cancel your order. All orders typically ship out within 1-3 business days.

Not For Resale or Export.

You agree and represent that you are buying for your own internal use only, and not for resale or export. Products may not be sold, leased or transferred to restricted countries, restricted end users or for restricted end uses.

Governing Law.

The laws of the State of Karnataka without regard to principles of conflict of laws, will govern these Terms of Sale and any dispute of any sort that might arise between you and SMAC INDIA. Any dispute arising between you and SMAC INDIA to be resolved exclusively by the state and/or central courts of the Karnataka/India.

IMPORTANT: SMAC India does not sell alco beverage products, electronic booking of products is fulfilled only at authorized retail outlets. Shipping of alcohol beverage products is not permissible by law in some states of India.
